Existing Regulators

Regulators need to ensure that they are consistently effective and fit for purpose. This involves balancing the interests of many stakeholders and using their resources efficiently. Regulating in a fast-paced and often changing external environment means that regulators need to be strategic and agile. We understand how challenging it can be to make sustainable change while keeping the day to day going.

Find out more about how we can help:

  • We review existing processes to help you identify weaknesses, necessary enhancements & deliver robust outcomes in a timely way.

    Ensure you are using your resources appropriately and minimise your legal spend.

  • This may follow on from our review or you may already know what you want to achieve but need support in getting there. We have experience in managing and implementing licensing & registration frameworks, appeal structures and disciplinary/adverse decision-making frameworks.

  • Corporate governance is an essential requirement as regulatory bodies are covered by the Code of Practice for the Governance of State Bodies. However we understand that effective governance in regulatory bodies has unique challenges, different to other corporate bodies. We are experienced in working with boards, committees, senior leadership teams, policy-makers and staff to effect and manage change including change to decision-making pathways, committee structures, composition and reporting arrangements.

  • Support with planning, identification of resources needed, working with key stakeholders and providing a wrap-around service to ensure the success of your project. We have experience in managing significant implementation challenges including recruitment & appointment of senior independent decision-makers and delivery of remote hearings solutions with partners.

  • Regulation is evolving all the time and regulators can face particular challenges with agility because they are governed by statute. Sometimes you need to look at the existing regulatory/corporate model and see whether it is fit for purpose. We provide advice and support with - strategic review of your structure, analysis of other options available & recommendations to enhance your regulatory impact and give you more flexibility to respond to regulatory challenges as they arise. We have a proven track record of securing internal and external buy-in for key legislative change.

  • We have extensive experience in operationalising new legislation- going from legal concepts to concrete deliverables. Some of our experience in this area includes:

    • Launching a new statutory inquiry process for a regulator;

    • Scoping and delivering all aspects of statutory investigations being carried out for the first time by a regulator;

    • Scoping and delivering all aspects of an adverse decision-making process for a regulator using its registration powers;

    • Working with stakeholders to scope and deliver new legislation affecting regulatory functions.

  • Regulators need to manage conflicts of interest, ensure fair procedures, make sure their processes are effective, timely and transparent. All regulatory decisions need to be supported by clear and cogent reasons and need to be evidence-based. Most importantly regulators need to act in the public interest. We are experienced in working with regulators to identify root causes of recurring regulatory/governance issues and delivering practical solutions to address these issues.
